Abstract

the introduction of shariah practice in Northern Nigeria is a turning point in the history of Islam in Nigeria.Zamfara state pioneered the introduction of the legal system and eleven other states in the north followed suit. Criminal cases have been tried and while some criminals were sentenced accordingly, many others were appealed. the case of Amina Lawal is highly celebrated under the new legal system as it attracted the attention of the entire world majorly because the punishment for the offence she committed has to deal with life. this work examined the different judgment by the judges at both the trial and the appeal courts to establish the accuracy or other wise of the judgment so passed against her using a historical research method. findings of the work revealed that the law of Islam is flexible and deterrent in nature and so, judges should employ all available means within their disposal to make sure that they did not inflict punishment on an accused by error
