    An Appraisal of the Legal Access to Family Justice in Yoruba Land of Nigeria

    The paper focuses on the choice open to Muslim women on access to family justice in Yoruba land, Nigeria vis a vis the extant courts Islam has been in Yoruba land as dated back to 14th Century but with no single Islamic court being established to cater for Muslim cases. The lawmakers in these areas did not see the need for creation of additional courts in these areas despite the powers vested in them by the constitution of the land to create additional courts where so desire without necessarily occasioning any injustice The aim of this paper is to examine the extant courts and access the extent to which they have protected the interest of the Muslim women in this region The paper adopts doctrinal method where both primary and a secondary literature on the subject were analysed. The finding of this paper reveals that the inability of the government authority to sign and ratify the establishment of Muslim courts in these regions has contributed to the rate at which women are being abused and thrown out of their matrimonial homes. Hence, the paper recommends the establishment of Muslim (Shari'ah) Courts in Yoruba land so as to regulate all these anomalies.

    Dispute Resolution Mechanism for Electricity Supply Industry in Nigeria.

    Many Nigerian artisans have being rendered inactive in their various callings. One of the reasons for this is the poor supply of electricity by the designated industry. Unfortunately, man of these artisans do not know where to go and lodge their complaints when they are served with expensive electricity bills. Therefore, this paper is aimed at evaluating the legal framework for electricity supply dispute resolution in Nigeria. It also examines the effectiveness of this legal framework. This paper employs a quantitative research approach by using a survey design for data collection a descriptive statistics for data analysis of the 15 stakeholders who ere surveyed. The review showed that a dispute resolution outlet is provided for customers who may wish to express their complaints about easy access an quick settlements. The fining also reveal that the industry has moved to other more result-oriented dispute resolution mechanism such as mediation, arbitration, conciliation among others. There is a regulatory commission charged with the dispensation of justice on dispute resolution. However, what is left is public enlightenment to enable people to explore this available dispute resolution outlet i order to minimize the settlement.

    The Nigerian Construction Industry is one of the pivotal sector that sustain the Nigeria Economy outside oil and gas. The construction sector is highly hazardous and a dispute prone industry. The use of Alternative dispute resolution (ADR) technique panacea to address the ever increasing challenges and problems of the construction sector have gained considerable acceptability in Nigeria. All tiers of government have after some reluctant now embrace ADR as a fundamental tool in recent years. The Nigeria government and key sectors contributors have accepted inclusion of ADR methods as an integral part of dispute resolution procedure in the standard form of contract for use in government and private projects. Several reasons currently accounted for low utilization of ADR in the Nigeria construction industry. These include lack of experience and knowledge. This paper examine the legal cum policy framework and implores the conceptual process and prerequisite of a successful ADR process. The study reveals that the nature of dispute dictates the type of mechanism to employ. A dispute may become complex if appropriate mechanism is not employed. Therefore, ADR has a lot to offer in streamlining the dispute resolution mechanism use for construction dispute resolution in nigeria. The major part of the study is dedicated to propose reform in administration of justice in construction dispute in Nigeria. meanwhile the UK an Malaysia models of ADR for construction dispute resolution are closely studied with a view to proposing practical reform for dispute resolve in nigeria.

    This paper examines the additional benefits of developing a democratic rule of law and fundamental rights based system vis a vis the protection of minorities in Nigerian from an intersectional viewpoint. The constitution and other legal enactments provide for establishment of mechanisms for the promotion and enforcement of the rights of religious minorities. It brings into focus the state of play regarding the main challenges depicting the protection of ethnic, religious minorities in the country in light of existing international and regional legal standards. Minority protection is a major concern in enlargement processes as a conditional criterion to accede to international community. A glance at the accession reveals that the dream is yet to be realised. The diversity of religions has influence the distribution of political positions, infrastructure, and economic opportunities as well as the minorities' rights. Hence, the paper proposes several policy options to address this gap. It also suggests specific ways in which democracy, the rule of law and fundamental rights, could effectively impacted on minority protection

    “Mediation as an Effective Dispute Resolution in Islamic Family Law in Nigeria

    The divorce rate is becoming more alarming among the Muslim couples in Nigeria despite legal framework for family dispute resolution mechanism provided by the existing laws. This therefore, calls for a re-examination of the method use for resolving disputes arising from the relationships between Muslim couples. It is a known fact that dispute has become part of human activities in life but this can be positively managed and controlled through the use of right mechanism. Dispute among the Muslim couples can be managed and controlled using mediation process as practiced during the time of Prophet (saw) and his companions, however, the involvement of mediators as mentioned in the Holy Qur'an for maintaining peace among the couples is worthy of precise role clarification.
