Abstract

Rights and development in Africa are two key concepts that have been a subject of discourse for so long. This is owing to the low standard of living and corruption being an obstacle to development and developmental rights in Africa. This chapter views human rights as moral principles or norms that describe certain standards of human behaviour and are regularly protected as natural and legal rights in municipal and international law. Development within the conceptual framework of this chapter refers to the process by which a nation improves the economic, political and social wellbeing of its people. Over the years, corruption has been a pressing issue in Nigeria and other African countries and this, to an extent, is the main reason for the epileptic development in sub-Saharan Africa. The chapter proceeds on a doctrinal approach to examine the impact of corruption on the right to development in Nigeria and concludes that if the Nigerian judiciary is repositioned it would aid the realisation of the right to development.
