Item Al-Ilory wa naqduhu li Zahirah al-Istishraq fi Naijiriya: Dirasah Istiqra’iyyah tahliliyyah [Arabic](2018) Yusuf, AbdulHameed Badmasإن الاستشراق ظاهرة علمية ثقافية تعنى بدراسة العرب ولغتهم ودينهم وشريعتهم وتاريخهم وكل ما له صلة بالشرق وأهله. و توغلت هذه الظاهرة بلاد نيجيريا بفضل الاستعمار والتنصير، وعمل المستشرقون على تأسيس قسم خاص بدراسة اللغة العربية والدراسات الإسلامية في جامعة إبادن بصفة خاصة، الأمر الذي جعل المستشرقين الذين كانوا –غالبا- يهودا ونصارى يدرّسون الطلبة المسلمين لغتهم العربية ودينهم الإسلامي. ولقد تنبّه الإلوري إلى خطورة هذا الوضع ونادى- محذرا- المسلمين من مكايد المستشرقين ومحاولتهم تحريف رسالة الإسلام ومحو لغته من عقول الطلبة المسلمين وإبدالها باللغة الانكليزية وثقافتها. وانطلاقا مما سبق، يتناول هذا المقال بالدراسة انطباع الإلوري ونقده لظاهرة الاستشراق خلال مؤلفاته المختلفة. ويستخدم الباحث منهجي الاستقراء والتحليل لتحقيق هدف البحث. وتوصل البحث إلى أن الاستشراق أسهم في تأسيس قسمي اللغة العربية والدراسات الإسلامية في بعض جامعات نيجيرية غير أنه ترك آثارا سلبية حيث إن مفاسده أكثر من فوائده كما هو واضح في وضع اللغة العربية والدراسات الإسلامية في معظم الجامعات النيجيرية إذ تدرس اللغة العربية في بعض تلك الجامعات باللغة الانكليزية كما تدرس فيها الدراسات الإسلامية مجردة من اللغة العربية وبالاعتماد المطلق على مؤلفات المستشرقين على حساب مؤلفات العلماء المسلمين، مما يدل على أن تخوف الإلوري وتحذيره من خطورة الاستشراق كان في محله. وأوصى البحث بضرورة إعادة النظر في مناهج التدريس في قسمي اللغة العربية والدراسات الإسلامية في بعض الجامعات النيجيرية لتنقيتهما من صبغة الاستشراق.Item Al-Wazi’ al-Dini wa Ahmiyyatuh fi Qam’ al-Fasad fi Naijiriyah [Arabic](Nigeria Teachers of Arabic and Islamic Studies (NATAIS), 2017) Yusuf, AbdulHameed Badmasتهدف هذه الورقة لتشخيص داء الفساد الذي يصيب بلاد نيجيريا بغية الكشف عن أسبابه ووصف الدواء المناسب لعلاجه, هذا واعتبر الباحث الوازع الديني العنصر المفقود في جميع الأدوية التي قد قدمتها الحكومة للتخلص من داء الفساد, وأوصت بجعل المادة الدينية إجبارية في المدارس لترسيخ القيم في الصبيان.Item Common Religious Values in Christianity and Islam as Bases for Unity in Nigeria(University of Ilorin Library and Publications Committee, 2018) Yusuf, AbdulHameed BadmasMuslims and Christians have been living together in Nigeria as citizens for many years, more especially after independence. However, over the years, their relationship has been fraught with mistrust and occasional violence. This hostile relationship persists despite the fact that both religions are of Abrahamic origin with virtually same moral values. But the recent anti-gay law passed by the National Assembly has helped to unveil one of the common moral values upon which both religions agree, which is immoral nature of homosexuality. This paper discusses the positive reactions of some religious bodies belonging to Islam and Christianity in Nigeria to the antigay law which is symptomatic of the agreement of both religions on some common moral values. To achieve the objective of this paper, comparative and historical methods are employed. The paper finds that the positive reactions of umbrella Muslim and Christian bodies in Nigeria to the antigay law (same-sex marriage) passed by the Nigerian government, though accidental, are hinged on the fact that homosexuality is considered an abominable act in Christianity and Islam. It concludes by recommending that both Muslims and Christians should explore more of such common moral values in their respective religions with a view to leveraging on same to jointly fight social vices such as corruption in the country. And in their quest to ensure reform in the process of legal derivation, they developed the theory of maqāṣid al-Sharīʿah as a formidable legal theory by which legal rules can be derived from the primary sources (i.e. Qurʾān and Sunnah). Their ultimate objective in this regard was to arrive at legal rules that promote the legitimate benefit (maṣlaḥah) of the religiously accountable person (al-mukallaf). The symbiotic relation that exists between the theory of maqāṣid al-Sharīʿah and the concept of tajdīd (i.e. reform/renewal/revival) is the focus of this paper. It shall show how classical and modern scholars (e.g. al-Juwaynī, al-Shāṭibī, Muhammad Abduh, Rashid Rida, Ibn Ashur etc.) conceived of the theory as a tool for the overall reform in their respective societies.Item Expositions of Al-Shatibi and Ibn Ashur on Methodic Ways of Establishing Maqasid al-Shari’ah (Objectives of Islamic Law)(Centre for Islamic Studies, Usmanu Dan Fodio Sokoti, 2019) Yusuf, AbdulHameed BadmasThe theory of Maqasid al-Shari’ah is based on a very sound proposition namely that the divine Law i.e. Shari’ah is purpose-oriented. It seeks to achieve certain objectives which are conducive for human welfare. Though, the divine Law has such human-centered objectives, the challenge is how to identify them. This paper seeks to explore the methodic ways of knowing the objectives of Islamic law. This shall be done through the lenses of al-Shatibi and Ibn Ashur, the two great jurists whose inputs were greatly instrumental to the evolution and standardization of the theory of objectives of Islamic law in the eighth and the fifteenth centuries of hijrah calendar respectively. While it is important to know the objectives of Islamic law, it is more important to understand how these objectives can be identified. This difficult task was undertaken and explained by the two most important jurists of Maqasid al-Shari’ah in their respective works, namely, al-Muwafaqat and Maqasid al-Shari’ah al-Islamiyyah. The methodic ways propounded by these scholars shall be analyzed together in a complementary manner. Hence analytical method shall be employed.Item Madrasat Dar al-’lum wa Is-hamat Khirrijihah fi al-Majal al- Akademi.(2015) Yusuf, AbdulHameed Badmasتحتلّ مدرسة دار العلوم إسلى كوتو مكانة مرموقة بين المدارس الموجودة في بلاد إلورن، ذلك لأن تأسيسها تمّ على أيدي علماء البلاد وأئمتها بأمر ملكي صادر من الأمير محمد ذي القرنين الغمبري. وخلال خمسىة عقود من تأسيسها قد خرّجت المدرسة أساتذة متنورين ينفعون العباد بما حصّلوا من العلوم اللغوية والشرعية كما يُسهمونفي تقدّم البلاد بأفكار نيرة في ميادين مختلفة. وتأتي هذه الورقة لتبرز إسهامات قيمة لبعض خريجي هذه المدرسة العريقة في المجال الأكاديمي بجامعات نيجيرية مختارة، وهي جامعة عثمان بن فوديبصكتو، وجامعة إلورن، وجامعة ولاية كوارا. تبدأ الدراسة بنبذة يسيرة عن المدرسة، وتُثنىّ بسيرة ذاتية لكل من الأساتذة المختارين لهذا البحث، مع التركيز على إسهاماتهم في تعزيز اللغة العربية والدراسات الإسلامية في الجامعات الثلاث، ثم تتتهى بالخاتمة.Item Maqasid al-Shari'ah wa Ahmiyyatuhah inda al-Ifta(Department of Arabic and slamic Studies, al-Hikmah University, Ilorin, Nigeria, 2016) Yusuf, AbdulHameed Badmasتتناول هذه الورقة بالدراسة موضوع الفتوى بهدف إبراز الأدوات التي تجعل الفتوى تحقق ما يقصده الشارع من المقاصد السامية التي غايتها ضمان مصلحة العباد بحفظ دينه ونفسه وعقله ونسله وماله. والورقة تنتظم في أربعة محاور بين المقدمة والخاتمة. يتناول المحور الأول الكلام عن الفتوى لغة واصطلاحاً، بينما يهتم المحور الثاني ببيان مفهوم المقاصد الشرعية. أما المحور الثالث فهو بيان لأهمية علم المقاصد الشرعية عند الإفتاء. والمحور الرابع عبارة عن سرد ودراسة أدوات الفتاوى المقاصدية. وعليه اعتمد الباحث المنهج التحليلي لدراسة هذه الأدوات دراسة عميقة لأنه يناسب طبيعة هذا البحث. ومن نتائج البحث أن الفتوى لا يمكن أن تحقق المقاصد الشرعية إذا لم يعتد المفتي بأدواتٍ منها التيسير ومراعاة الظروف وغيرهما مما سيتم بيانه في البحث إن شاء الله.Item Maqasid al-Shari'ah: A General Overview of Objectives of Islamic Law(Department of Islamic Law, Faculty of Law, al-Hikmah University, Ilorin, Nigeria, 2019) Yusuf, AbdulHameed BadmasIslamic law is a purpose-oriented divine law. All rules legislated by the Law-Giver are geared towards the realization of welfare or benefits (maslahah) of man, who is the subject of the law. The theory of maqasid al-Shari’ah has been dedicated to the study of the purpose of every given rule of the shari’ah. This paper seeks to explore the said theory with a view to exploring its multifarious aspects ranging from its definition to its types and significance. Attempt shall also be made at tracing the historical background of the theory in order to appreciate how it was developed from within the rubric of the science of usul al-fiqh by classical jurists, consolidated by medieval scholars, and promoted by contemporary scholars. As such, both historical and analytical methods shall be employed to achieve the set objectives. Internet precisely has made available many useful materials and data thereby facilitating teaching and learning. This influence is especially manifest in the field of Islamic studies, whereby internet has been employed to pass and communicate fatwā i.e. Islamic verdict. Thus the scope of fatwā unlike before is no more limited between muftī [the scholar] and mustaftī [the questioner]. This article seeks to study this phenomenon from both negative and perspective perspectives. The idea is to dwell on the need and ways to ensure a judicious use of the medium. This is necessary when we take into consideration the lofty position of fatwā in Uṣūl al-Fiqh i.e. the principles of Islamic jurisprudence. Many notable scholars have considered muftī as an interpreter and deputy of Allah and His prophet respectively. Moreover, muftī has also been likened to a medical doctor whose prescription of drug must be carefully made. While the latter takes care of body, the former is responsible for soul, a task that must be carried out more carefully and effectively. Thus the article contends that to avoid abuse of fatwā through the means of internet concerted efforts must be made by concerned scholars who work as e-muftīs on various websites. The institution of fatwā must be recognized as an area of specialization in order to ensure that only qualified undertake the task of passing and communication of e-fatwā.
